These Terms and Conditions are issued by Let's Bounce Australia Pty Ltd (ABN 652 202 278), a wholly owned subsidiary of Bounce Rideshare Pty Ltd (ABN 651 064 952).
PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE BOUNCE DRIVER PLATFORM.
In these Terms, “Bounce”, “we”, “us” and “our” means Let's Bounce Australia Pty Ltd, the operator of the Bounce Driver Platform.
These Driver Terms and Conditions govern your access to and use of the Bounce Driver Platform, including the driver-facing mobile application made available under the name “Bounce Driver”.
By creating or applying for a Driver Account, submitting onboarding information, accessing or using the Bounce Driver Platform, going online, receiving or accepting Trip Requests, completing Trips or otherwise using any part of the Bounce Driver Platform, you agree to be bound by:
Together, these documents form the agreement between you and Bounce concerning your access to and use of the Bounce Driver Platform.
If you do not agree to these Terms, you must not create a Driver Account, access the Bounce Driver Platform, go online or provide Trips through the Bounce Driver Platform.
In these Terms, unless the context requires otherwise:
Access Fee means any amount payable by you for access to the Bounce Driver Platform, including an amount charged under a Bounce Access Pass.
Applicable Law means all laws, regulations, rules, standards, codes, licence or accreditation conditions, regulator directions and legally binding requirements applying to you, your Vehicle, the Driver Services or your use of the Bounce Driver Platform.
Bounce Access Pass or BAP means a time-limited right to access and use certain Driver Platform functionality in return for an Access Fee, as described in the Bounce Driver App.
Bounce Driver App means the driver-facing mobile application operated by Bounce and made available under the name “Bounce Driver”, together with its updates, replacement versions, features, tools, software, interfaces and related driver-facing services.
Bounce Driver Platform means the Bounce Driver App and all related systems, software, websites, communications, payment functionality, support services and driver-facing technology made available by Bounce.
Bounce Rider App means the rider-facing mobile application through which Riders may request or arrange Trips.
Driver, you and your mean the individual who applies for, holds or uses a Driver Account.
Driver Account means the account created or approved for you to access the Bounce Driver Platform.
Driver Earnings means amounts payable to you in connection with completed Trips, excluding amounts that Bounce is entitled or required to deduct, withhold, reverse or recover.
Driver Services means the passenger transport and related services personally provided by you to Riders.
Payment Processor means Stripe or another third-party payment service provider nominated by Bounce.
Rider means a person who requests, books, receives or is intended to receive a Trip through the Bounce Platform and includes any authorised guest or additional passenger travelling under the booking.
Trip means a passenger transport service requested, arranged or recorded through the Bounce Platform.
Trip Fare means the fare, charge or other amount payable by or on behalf of a Rider for a Trip, before or after any applicable adjustment, discount, promotion, toll, tax, levy or fee.
Trip Request means a request for Driver Services made available to you through the Bounce Driver Platform.
Vehicle means each vehicle registered, nominated or used by you to provide Driver Services through the Bounce Driver Platform.
Bounce provides technology that may enable Drivers and Riders to connect, communicate and arrange Driver Services.
Unless expressly stated otherwise, Bounce does not itself provide the Driver Services performed by you. You are responsible for personally providing those services in accordance with Applicable Law and these Terms.
Bounce does not guarantee:
Any information regarding demand, estimated earnings, estimated fares, travel times, routes or Trip availability is indicative only and may change because of traffic, weather, Rider activity, location, system conditions or other factors.
To create and maintain a Driver Account, you must:
You must continue to meet these requirements for as long as your Driver Account remains open.
Meeting the minimum eligibility requirements does not guarantee approval. Bounce may refuse an application where reasonably necessary for safety, compliance, platform integrity, fraud prevention, operational or legal reasons.
You must obtain and maintain all licences, registrations, accreditations, permits, authorities, approvals and documents required to provide Driver Services in every jurisdiction in which you drive.
You must:
Bounce may restrict, suspend or deactivate your Driver Account where a required licence, accreditation, approval or document is missing, invalid, expired, under review or cannot be verified.
Your Driver Account is personal to you. You must not:
You must keep your login credentials, verification codes and account security information confidential.
You must immediately notify Bounce if you believe that your Driver Account or login credentials have been lost, stolen, accessed without authority or otherwise compromised.
Bounce may require you to complete identity verification, facial verification, selfie checks, document verification, background screening, liveness checks or other security checks before or during your use of the Bounce Driver Platform.
You must personally complete all identity and security checks honestly and must not attempt to avoid, manipulate or interfere with them.
You must ensure that all information and documents supplied to Bounce are genuine, accurate, complete, legible and current.
This may include:
You must notify Bounce promptly if any information previously supplied by you changes or becomes inaccurate, incomplete, expired or misleading.
Providing false, altered, forged, misleading or fraudulently obtained information may result in rejection, immediate suspension or permanent deactivation and may be reported to relevant authorities.
To the extent permitted by law, you authorise Bounce and its service providers to conduct initial and ongoing checks relevant to your eligibility, including:
Bounce may require updated documents or repeat checks periodically or when a safety, compliance, fraud or identity concern arises.
Your Driver Account may be restricted while a check is incomplete or under review.
Your profile photograph must be a recent, clear and accurate image of you and must comply with the photograph requirements displayed in the Bounce Driver App.
The photograph may be shown to Riders and used for identity, safety and account verification purposes.
You must not use an image of another person, an edited or misleading image, an image containing filters or an image that prevents you from being readily identified.
Bounce may require approval of a replacement profile photograph. Your Driver Account may be temporarily suspended while a replacement photograph is reviewed.
Each Vehicle used through the Bounce Driver Platform must:
Unless Bounce approves otherwise, a Vehicle must not be more than 15 years old and must satisfy any more specific age requirement applying to the relevant service type.
You must only provide a Trip using the Vehicle selected and displayed in the Bounce Driver App for that Trip.
You must not substitute another Vehicle without first registering and receiving approval for that Vehicle.
You are responsible for arranging and paying for all inspections, maintenance and repairs required for your Vehicle.
You must:
Bounce may require a Vehicle to undergo an additional inspection following a crash, safety complaint, material defect, significant repair or other safety-related event.
You must obtain and maintain all insurance required by law and any additional insurance reasonably required by Bounce for the Driver Services you provide.
You are responsible for confirming that your insurance policy permits the Vehicle to be used for rideshare, hire car, taxi or other commercial passenger transport services.
You must not provide Driver Services if your insurance is expired, cancelled, suspended, invalid, inadequate or does not cover the commercial use of your Vehicle.
You must notify Bounce promptly of any event that may materially affect your insurance, including a collision, claim, cancellation, refusal of cover or policy restriction.
Any insurance arranged or referred to by Bounce is subject to the terms, conditions, limits, exclusions and eligibility requirements of the relevant policy. Bounce does not guarantee that a particular loss or claim will be covered.
Subject to Applicable Law, you provide Driver Services as an independent contractor and not as an employee, worker, agent, partner or representative of Bounce.
Nothing in these Terms creates an employment, agency, partnership, joint venture, fiduciary or franchise relationship between you and Bounce.
Subject to these Terms and Applicable Law:
You must not represent that you are an employee, officer, authorised agent or legal representative of Bounce.
This clause operates only to the extent permitted by law and does not exclude any right or protection that cannot lawfully be excluded.
You may receive Trip Requests while your Driver Account is active, you are online and you meet the applicable eligibility requirements.
You may generally choose whether to accept a Trip Request. However, your acceptance, rejection, cancellation and completion activity may be recorded and may be considered for safety, fraud prevention, service quality, eligibility or promotional purposes.
Before accepting a Trip Request, you are responsible for determining whether you can safely and lawfully complete it.
Once you accept a Trip Request, you must make reasonable efforts to:
You must not accept a Trip Request that you do not genuinely intend or are not legally able to complete.
Bounce may require a Rider to provide a Trip PIN or other verification information before a Trip can begin.
Where verification is required, you must not start the Trip in the Bounce Driver App until the correct verification information has been entered and accepted.
You must not ask a Rider to send a Trip PIN through an unsecured message or provide it before you are physically present at the pickup location, except where expressly permitted by Bounce.
You must not attempt to bypass, guess, manipulate or disable a Trip verification process.
You must provide every Trip safely, lawfully, professionally and with reasonable care and skill.
You must:
You must not discriminate against a Rider or refuse a Trip for an unlawful discriminatory reason.
While using the Bounce Driver Platform or providing Driver Services, you must not:
You must be medically and physically fit to drive whenever you go online or provide Driver Services.
You must not go online or drive if:
Where Applicable Law requires a zero blood alcohol concentration, you must maintain a blood alcohol concentration of 0.00 while driving.
Bounce may require you to complete a pre-trip or pre-online declaration confirming that you are fit to drive.
A declaration does not replace your continuing obligation to monitor your fitness throughout the period in which you are online or driving.
You must comply with all legal limits applying to driving time, logged hours, fatigue management and required rest periods.
The Bounce Driver App may record or estimate the time you spend online, travelling to Riders or providing Trips.
Bounce may restrict your ability to remain online where you reach or are approaching a legal or platform safety limit.
A timer or hours record displayed in the Bounce Driver App is a safety aid only. You remain responsible for independently tracking all relevant work and driving time, including time spent driving through another platform or providing other transport services.
You must take all required rest periods and must not attempt to avoid an hours restriction by using another account, device or identity.
You must comply with all laws relating to mobile phone and electronic device use while driving.
You should place your device in a secure, commercially appropriate mount before beginning to drive.
You must not manually enter information, read lengthy messages or otherwise interact with the Bounce Driver App while the Vehicle is moving unless the interaction is lawful and can be completed safely.
You must safely stop and park before carrying out any task that may distract you from driving.
Assistance animals are not pets.
You must comply with all laws protecting persons who travel with an assistance animal.
You must not refuse, avoid, cancel or disadvantage a Rider because the Rider is accompanied by a lawful assistance animal.
This obligation applies regardless of whether the Trip was requested through a pet-specific service type.
You may ask only those questions permitted by law and must not require a Rider to place an assistance animal in a carrier, boot or other unsuitable area.
You may use reasonable protective measures, such as carrying a clean blanket, provided those measures do not restrict or disadvantage the Rider or assistance animal.
You must comply with all Bounce policies and Applicable Laws concerning minors and vulnerable passengers.
Unless Bounce expressly offers and authorises a service for unaccompanied minors, you must not knowingly transport an unaccompanied person who is below the minimum permitted age.
You must not request identification from a Rider unless reasonably required for safety, legal compliance or an authorised Bounce process.
If you reasonably believe that a person is at immediate risk of harm, you should contact emergency services and notify Bounce as soon as it is safe to do so.
You and the Rider must comply with all laws relating to child restraints and seatbelts.
You must not begin or continue a Trip if doing so would involve carrying a child unlawfully or without a legally required restraint.
Unless Bounce expressly provides otherwise, you are not required to supply a child restraint. However, you must permit a Rider to use a lawful and suitable restraint where it can be safely installed.
Where you opt into a pet-friendly service, you agree to transport ordinary domestic pets subject to reasonable safety requirements.
You may require a pet to be appropriately restrained where lawful and reasonably necessary for safety.
You may not treat an assistance animal as a pet or apply a pet-related refusal, condition or charge to an assistance animal.
You are responsible for maintaining a reasonably clean Vehicle and for promptly reporting any material cleaning issue through the Bounce Driver App.
You are responsible for ensuring that any dashcam, audio recorder, camera or other recording device used in or around your Vehicle complies with all Applicable Laws.
You must:
Recordings should only be used for lawful purposes, such as personal safety, insurance, reporting an incident to Bounce or providing information to emergency services, police or another authorised body.
Registration of a recording device with Bounce does not mean that Bounce has approved the device or confirmed that your use of it is lawful.
You may cancel a Trip where reasonably necessary, including where:
You must select an accurate cancellation reason in the Bounce Driver App.
You must not cancel or threaten to cancel a Trip to obtain an additional payment, avoid an assistance animal, discriminate against a Rider, induce an off-platform Trip or manipulate fares, incentives or platform metrics.
Excessive, fraudulent, discriminatory or unjustified cancellations may result in warnings, restrictions, loss of promotional eligibility, suspension or deactivation.
The Bounce Driver App may apply a waiting period before a Trip becomes eligible for a Rider no-show cancellation or cancellation payment.
You must arrive at the correct pickup location and make reasonable efforts to notify the Rider of your arrival.
You must not falsely indicate that you have arrived, intentionally stop at an inaccessible location or manipulate location information to obtain a cancellation payment.
Any cancellation payment is subject to the conditions displayed in the Bounce Driver App and may be adjusted, withheld or reversed where an error, misuse or fraudulent conduct is identified.
You must not solicit, accept or provide an unauthorised street hail, touting arrangement or other unlawful passenger transport service.
You must not use the Bounce Driver Platform to identify or connect with a Rider and then move the Trip outside the Bounce Platform.
Prohibited conduct includes:
Touting or off-platform conversion may expose you to fines, regulatory action, loss of insurance coverage and permanent deactivation. Bounce may also refer suspected unlawful conduct to relevant authorities.
Trip Fares may be calculated using rates, estimates, pricing rules or other methods displayed in the Bounce Platform.
A Trip Fare may include:
A fare displayed before a Trip may be an estimate and may change because of the actual route, travel time, destination changes, stops, tolls, traffic, waiting time or other circumstances.
Unless Bounce expressly permits another payment method, you must not ask or require a Rider to pay the Trip Fare outside the Bounce Platform.
Bounce may operate an Access Fee model under which you pay for access to the Bounce Driver Platform rather than Bounce deducting a percentage commission from each Trip Fare.
The applicable Bounce Access Pass category, duration, price and conditions will be displayed in the Bounce Driver App or an applicable fee schedule.
Unless otherwise displayed:
The current Access Fee, earning threshold and pass conditions will be shown before or when the relevant pass is activated.
Bounce may introduce, withdraw or change an Access Pass, provided that any change is notified or displayed as required by law.
Subject to these Terms, Driver Earnings will generally consist of amounts attributable to completed Trips after accounting for:
Earnings information displayed in the Bounce Driver App may be provisional until the Trip, Rider payment and applicable adjustments have been processed.
Bounce may correct an error in a fare, fee, earnings calculation or account balance.
To receive payouts, you must provide and maintain valid bank account and Payment Processor information.
Your bank account details should correspond with your verified legal identity. A mismatch may delay verification or payment.
Payouts may be subject to:
Bounce is not responsible for a delay caused by incorrect bank details, an unsupported bank account, bank processing, Payment Processor review, network failure or another matter outside Bounce's reasonable control.
Bounce may make weekly payouts available to eligible Drivers.
The applicable processing day, earnings period and estimated arrival time will be displayed in the Bounce Driver App.
Unless otherwise notified, eligible weekly payouts may be processed each Monday for Trips completed during the applicable preceding weekly earnings period.
A weekly payout is considered processed when Bounce or the Payment Processor submits the payment. The time at which funds appear in your bank account will depend on your financial institution.
Bounce may allow eligible Drivers to request an Express Payout.
Express Payout eligibility may depend on:
Bounce may apply a transaction fee and daily or transaction limit to Express Payouts. The applicable fee and limit will be displayed before you confirm the payout.
An Express Payout may fail or be delayed where your bank does not support the relevant payment network, your information is incorrect, a limit is exceeded or a security review is required.
Bounce may adjust, withhold, reverse or recover an amount where reasonably necessary because:
To the extent permitted by law, you authorise Bounce to set off an amount you owe against current or future Driver Earnings.
Bounce will provide information about a material adjustment where reasonably practicable.
You are responsible for obtaining independent advice about your tax, accounting and business obligations.
You are responsible for:
Bounce may collect, report, retain or disclose payment, identity, tax and transaction information where required by law.
Unless required by law, Bounce is not responsible for withholding or paying tax, superannuation, leave, workers compensation or employment entitlements on your behalf.
Tolls, airport charges, government levies and similar amounts may be added to the Trip Fare or otherwise dealt with as displayed in the Bounce Driver App.
You are responsible for using lawful pickup and drop-off areas and for complying with airport, road, parking and access requirements.
Bounce is not responsible for a fine, infringement, parking charge, access charge or penalty incurred because of your conduct or Vehicle use.
Bounce may offer promotions, incentives, guarantees, referral benefits or other programs subject to additional conditions.
Unless expressly stated, a promotion:
You must comply with the conditions displayed for each promotion.
Riders may submit ratings, compliments, complaints and other feedback about Trips.
Bounce may use ratings and feedback for:
Bounce does not guarantee that all feedback will be accurate. Where appropriate, Bounce may consider the surrounding circumstances, pattern of conduct and other available evidence.
You must not pressure, threaten or offer an unauthorised benefit to a Rider in exchange for a rating or the withdrawal of a complaint.
Bounce may investigate a complaint, safety report, payment dispute, regulatory concern or suspected breach of these Terms.
You must cooperate honestly and promptly with a reasonable investigation, including by:
Bounce may temporarily restrict your Driver Account while an investigation is conducted where reasonably necessary to protect safety, prevent fraud, preserve evidence or comply with legal obligations.
In an emergency or where there is an immediate threat to life or safety, call 000 before contacting Bounce.
You must report a serious crash, injury, assault, threat, sexual misconduct, missing person concern, Vehicle safety issue or other significant incident to Bounce as soon as reasonably practicable.
You must take reasonable steps to preserve evidence and cooperate with emergency services, police, regulators, insurers and Bounce.
Bounce's safety tools and support services do not replace emergency services and do not guarantee that assistance will be available or arrive within a particular time.
Some incidents involving commercial passenger vehicle services must be reported to the applicable transport regulator within a prescribed period.
You must comply with every legal obligation that applies to you concerning notifiable incidents.
You must also notify Bounce promptly of any incident that is or may be notifiable, including an incident involving:
Where you are uncertain whether an incident is notifiable, you should seek appropriate advice and report it rather than assume no report is required.
Reporting an incident to Bounce does not remove any separate legal obligation you may have to report it directly to Safe Transport Victoria, police, an insurer or another authority.
You must take reasonable steps to protect property left in your Vehicle.
You must not keep, use, sell, dispose of or withhold a Rider's property except as permitted by law.
If you find lost property, you should report it through the relevant Trip in the Bounce Driver App and follow the return instructions provided.
Bounce may facilitate communication between you and the Rider without disclosing personal contact details.
A lost-property return fee may be charged to the Rider and paid to you where the eligibility conditions displayed in the Bounce Driver App are met.
Bounce does not take possession of lost property and is not responsible for storing, protecting or returning it.
You may report material damage or a significant mess caused by a Rider during a Trip.
A claim must be submitted within the period stated in the Bounce Driver App and must include clear, genuine and relevant evidence.
Bounce may consider:
Bounce does not guarantee payment of a cleaning or damage amount.
You must not submit an inflated, duplicated, misleading or fraudulent claim.
You must not engage in or assist:
Bounce may withhold disputed amounts, investigate activity, reverse improperly obtained payments, restrict accounts and report suspected criminal conduct to relevant authorities.
Bounce collects, uses, stores and discloses personal information as described in the Bounce Privacy Policy.
This may include identity information, contact details, Driver and Vehicle documents, location information, Trip activity, communications, payment information, device information, safety information and support records.
You must handle Rider personal information lawfully and only for the legitimate purpose of providing the relevant Trip or addressing a genuine safety, support or lost-property matter.
You must not:
The Bounce Driver Platform may collect precise or approximate location information while the Bounce Driver App is running, while you are online, during a Trip and, where permitted by your settings and Applicable Law, in the background.
Location information may be used to:
Disabling required location permissions may prevent you from going online or using important features.
Bounce may communicate with you by in-app message, push notification, SMS, telephone, email or another contact method associated with your Driver Account.
Operational and safety communications may include information about:
You must maintain accurate contact details and regularly review important communications.
Marketing communications will be sent and may be opted out of in accordance with Applicable Law. Opting out of marketing does not prevent Bounce from sending essential operational, transactional, safety or legal messages.
The Bounce Driver Platform may rely on or integrate with third-party services, including:
Your use of a third-party service may be subject to separate terms and privacy policies.
Bounce is not responsible for the independent acts, omissions, availability or systems of a third-party service provider, except to the extent required by law.
Subject to your compliance with these Terms, Bounce grants you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use the Bounce Driver App solely for the purpose of accessing the Bounce Driver Platform and providing Driver Services.
You must not:
Bounce Rideshare Pty Ltd or its licensors own all rights, title and interest in the Bounce Platform and its intellectual property.
This includes rights in:
These Terms do not transfer ownership of any Bounce intellectual property to you.
You must not use Bounce's name, logo or branding except as expressly permitted through the Bounce Driver Platform or with prior written approval.
You may provide feedback, ideas or suggestions concerning the Bounce Platform.
To the extent permitted by law, you grant Bounce a worldwide, perpetual, irrevocable, royalty-free and transferable licence to use and incorporate that feedback without restriction or payment to you.
This clause does not give Bounce ownership of your personal information.
Bounce may update, modify, suspend, withdraw or discontinue any feature of the Bounce Driver Platform.
Bounce may require you to install an update before continuing to use the Bounce Driver App.
The Bounce Driver Platform may be unavailable because of maintenance, outages, network failure, third-party systems, emergencies, security incidents or events outside Bounce's reasonable control.
Bounce does not guarantee continuous, secure or error-free access, but this clause does not exclude any guarantee or right that cannot lawfully be excluded.
Bounce may temporarily restrict or suspend all or part of your Driver Account where reasonably necessary to:
Where appropriate and legally permitted, Bounce will provide information about the restriction and any action you may take.
Bounce may deactivate your Driver Account where:
Bounce may deactivate immediately where reasonably necessary because of a serious safety, fraud, legal or security concern.
Where required by law or reasonably appropriate, Bounce may provide notice, reasons or access to an internal review process.
You may request closure of your Driver Account through the Bounce Driver App or by contacting Bounce Support.
Account closure does not:
You must stop using the Bounce Driver Platform once your account has been closed or deactivated.
On suspension, deactivation or closure:
Clauses concerning payments, taxes, intellectual property, privacy, confidentiality, liability, indemnity, disputes and general legal matters survive termination to the extent necessary to give them effect.
You are responsible for your own acts and omissions in providing Driver Services and operating your Vehicle.
To the extent permitted by law, you are responsible for loss, damage, liability, fines, penalties, claims and expenses arising from:
To the extent permitted by law, you indemnify Bounce, Bounce Rideshare Pty Ltd and their related bodies corporate, officers, employees and agents against loss, liability, damage, claim, cost and reasonable legal expense arising from or connected with:
This indemnity is reduced to the extent that the relevant loss was caused or contributed to by Bounce's negligence, breach of contract or unlawful conduct.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.
Any exclusion or limitation in these Terms applies only to the maximum extent permitted by law.
Except for rights and guarantees that cannot lawfully be excluded, the Bounce Driver Platform is provided on an “as available” basis.
Bounce does not guarantee:
You are responsible for assessing the commercial, financial, legal and safety risks of operating as an independent Driver.
To the maximum extent permitted by law, Bounce is not liable for indirect, incidental, special or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of data, loss of goodwill or business interruption arising from or connected with the Bounce Driver Platform.
To the maximum extent permitted by law, Bounce is not responsible for loss caused by:
Where Bounce's liability may lawfully be limited, Bounce may elect to resupply the relevant service or pay the reasonable cost of having it supplied again.
Before commencing court proceedings, you and Bounce should attempt to resolve a dispute in good faith.
You should first contact Bounce Support and provide:
Bounce will review the matter and may request further information.
Nothing in this clause prevents either party from seeking urgent interlocutory relief, reporting a matter to a regulator or exercising a right that cannot lawfully be restricted.
Where Bounce makes an account decision that is eligible for review, you may request an internal review through the process communicated to you.
A review request should explain why you believe the decision should be changed and include any relevant evidence.
Bounce may decline to conduct repeated reviews where no materially new information is supplied.
An internal review does not prevent Bounce from maintaining an interim restriction where reasonably necessary for safety, legal compliance or fraud prevention.
Bounce may update these Terms to reflect changes to:
Bounce will provide notice of a material change as required by law, including through the Bounce Driver App, email or another reasonable communication method.
The updated Terms take effect on the date stated in the notice or updated document.
If you do not agree to an updated version, you must stop using the Bounce Driver Platform and may request closure of your Driver Account.
You may not assign, transfer or deal with your rights or obligations under these Terms without Bounce's prior written consent.
Bounce may assign or transfer its rights or obligations to a related body corporate or as part of a restructure, sale, merger or transfer of the Bounce business, provided this does not reduce any non-excludable right you have under law.

You are responsible for keeping your contact information current.
A failure or delay by Bounce in exercising a right does not waive that right.
A waiver is effective only if it is given in writing by an authorised representative of Bounce.
If any part of these Terms is invalid, illegal or unenforceable, that part will be read down to the minimum extent necessary or severed.
The remaining provisions will continue to operate.
These Terms, together with the documents incorporated into them, form the entire agreement between you and Bounce concerning your access to and use of the Bounce Driver Platform.
They replace any earlier agreement, representation or understanding about the same subject matter, except where otherwise expressly stated.
These Terms are governed by the laws of Victoria, Australia.
Subject to any right that cannot lawfully be restricted, you and Bounce submit to the courts of Victoria and any courts entitled to hear appeals from those courts.
