Terms & Conditions for Riders

These Terms and Conditions are issued by Let's Bounce Australia Pty Ltd (ABN 652 202 278), a wholly owned subsidiary of Bounce Rideshare Pty Ltd (ABN 651 064 952).

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE BOUNCE RIDER PLATFORM.

Overview

In these Terms, “Bounce”, “we”, “us” and “our” means Let’s Bounce Pty Ltd, the operator of the Bounce Rider Platform.

These Rider Terms and Conditions govern your access to and use of the Bounce Rider Platform, including the rider-facing mobile application made available under the name “Bounce Ride”.

By creating a Rider account, accessing or using the Bounce Rider Platform, requesting a trip, accepting a fare estimate, managing a booking, travelling on a trip, making a payment, using any feature of the Bounce Ride app, or otherwise using the Bounce Rider Platform, you agree to be bound by these Terms, the Bounce Privacy Policy and any other policies, notices, guidelines or additional terms made available by Bounce from time to time.

As part of the account creation, booking, payment or app-use process, you may be required to review these Terms through the Bounce Rider Platform and confirm your acceptance by selecting “Agree” or a similar confirmation option. Bounce may also require you to confirm your acceptance again where these Terms are updated or where continued access to the Bounce Rider Platform requires confirmation.

If you do not agree to these Terms, you must not create an account, access or use the Bounce Rider Platform, request trips, manage bookings, make payments or receive rideshare or commercial passenger vehicle services arranged through Bounce.

1. Definitions

In these Terms:

“Bounce Platform” means the technology platform made available by Bounce to Riders and Drivers, including the Bounce Ride app, Bounce Driver app, website, portals, software, systems, tools, account management features, trip booking features, location and map-based functions, payment facilitation, safety features, support services, communications, promotional features and related services.

“Bounce Ride” means the rider-facing mobile application operated by Bounce and made available under the name “Bounce Ride”, together with any related updates, replacement versions, features, tools, software, interfaces and rider-facing app services made available by Bounce from time to time.

“Bounce Rider Platform” means the parts of the Bounce Platform made available to Riders, including Bounce Ride, Rider account features, trip request features, trip management tools, payment features, safety features, support features, promotions, receipts, trip history and any other Rider-facing services made available by Bounce.

“Driver” means an independent third-party driver who uses the Bounce Driver Platform to receive, accept and complete trip requests.

“Rider”, “you” and “your” means any person who creates a Rider account, accesses the Bounce Rider Platform, requests a trip, takes a trip, pays for a trip, manages a booking or otherwise uses the Bounce Rider Platform.

“Trip” means a transport service requested by a Rider through the Bounce Rider Platform and accepted or provided by a Driver.

2. About Bounce

2.1 Bounce’s Role

Bounce provides a technology platform that enables Riders to request trips from independent third-party Drivers.

Bounce facilitates technology, booking, payment, communication, location, safety, support, reporting, account-management and platform-administration functions connected with trips arranged through the Bounce Rider Platform.

2.2 Transport Services Provided by Drivers

Unless otherwise expressly stated, Bounce does not itself provide transport services. Transport services arranged through the Bounce Rider Platform are provided by independent Drivers who are not employees, agents, partners, representatives, joint venturers or franchisees of Bounce.

2.3 No Guarantee of Driver Availability

Bounce does not guarantee that a Driver will be available, that a Driver will accept your trip request, that a vehicle will arrive within an estimated time, or that the Bounce Rider Platform will be available in every location at all times.

3. Acceptance and Application of Terms

3.1 Acceptance of Terms

By creating a Rider account, signing in, requesting a trip, accepting a fare estimate, completing a trip, making a payment, receiving services arranged through Bounce or otherwise accessing or using the Bounce Rider Platform, you agree to be bound by these Terms.

3.2 Additional Policies and Notices

These Terms apply together with any policies, guidelines, notices, standards, in-app instructions, additional terms or other requirements that apply to your use of the Bounce Rider Platform.

This may include policies relating to safety, payments, Rider conduct, privacy, promotions, referrals, app use, support, accessibility, assistance animals, lost items, cancellation fees, cleaning fees, refunds and complaints.

3.3 Legal Rights Preserved

Nothing in these Terms excludes, restricts or modifies any rights, guarantees, remedies or protections that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

4. Rider Eligibility and Account Requirements

4.1 Rider Eligibility

To access and use the Bounce Rider Platform, you must meet all eligibility, account, payment, identity, safety and operational requirements set by Bounce, Bounce policies and applicable law.

You must:

  1. be at least 18 years old, or any higher minimum age required by applicable law, unless Bounce permits use by a minor through an approved account or booking process;
  2. have legal capacity to create an account and accept these Terms;
  3. provide accurate, current and complete account, contact, payment and trip information;
  4. maintain a valid payment method where required;
  5. use the Bounce Rider Platform only for lawful and personal or authorised purposes;
  6. comply with all applicable laws, safety requirements, platform rules and Bounce policies; and
  7. not be suspended, restricted, deactivated or otherwise prohibited from using the Bounce Platform.

4.2 Account Registration

To use the Bounce Rider Platform, you may be required to create a Bounce Rider account and provide all information reasonably requested by Bounce.

Creating an account does not guarantee that the Bounce Rider Platform will be available in your area, that trip requests will be accepted, or that a Driver will be available at any particular time.

4.3 Account Information

Bounce may require you to provide information including:

  1. full name;
  2. mobile phone number;
  3. email address;
  4. payment information;
  5. pickup and drop-off locations;
  6. trip preferences;
  7. accessibility or assistance information you choose to provide;
  8. identity, verification or security information where required;
  9. support, complaint or incident information; and
  10. any other information Bounce reasonably requires to provide, secure, support or administer the Bounce Rider Platform.

4.4 Account Accuracy

You must ensure that all information provided to Bounce is true, complete, current and not misleading.

You must promptly update your account if your name, mobile number, email address, payment method, accessibility information or other account information changes or becomes inaccurate.

4.5 False, Misleading or Fraudulent Information

You must not provide, upload, submit or rely on any information, document, image, payment detail, account detail or declaration that is false, misleading, incomplete, inaccurate, expired, altered, forged, fraudulent or not your own.

If Bounce reasonably believes that you have provided or relied on false, misleading, incomplete, inaccurate, altered, forged or fraudulent information, Bounce may refuse a booking, cancel a trip, require further verification, suspend, restrict or deactivate your account, recover amounts incorrectly credited or refunded, or take other action reasonably necessary.

4.6 Account Security

Your Rider account is personal to you and contains your personal details, payment information, trip history, account information and access credentials.

You must not:

  1. transfer, assign, sell, lend, share or otherwise allow another person to access or use your Rider account without Bounce’s permission;
  2. allow another person to misuse your account, payment method, promotional credits or trip features;
  3. disclose, share or compromise your login details, device access, account information or security credentials;
  4. create or attempt to create multiple Rider accounts to misuse promotions, referrals, refunds, credits or platform rules;
  5. use another person’s account without permission; or
  6. attempt to bypass any suspension, restriction, deactivation, verification process or payment requirement.

You must notify Bounce as soon as reasonably practicable if you know or suspect that your account, login details, device, email address, mobile number, payment details or personal information have been lost, stolen, accessed, misused or compromised.

5. Rider Obligations

5.1 General Obligations

When using the Bounce Rider Platform or receiving transport services arranged through Bounce, you must act lawfully, safely, respectfully and in accordance with these Terms, Bounce policies, applicable laws and any requirements made available by Bounce from time to time.

5.2 Respectful Conduct

You must treat Drivers, passengers, Bounce representatives, regulators, authorities and members of the public respectfully.

You must not discriminate, harass, threaten, abuse, intimidate, assault, damage property, behave dangerously or act unlawfully towards any Driver, passenger, Bounce representative, regulator, authority or member of the public.

5.3 Safe and Lawful Behaviour

You must not use the Bounce Rider Platform or travel in a vehicle in a way that is unsafe, unlawful, abusive, disruptive, fraudulent, misleading, offensive or likely to cause harm, damage, delay or distress.

You must comply with reasonable safety instructions given by the Driver, Bounce, emergency services, police, regulators or other lawful authorities.

5.4 Seatbelts and Passenger Safety

You and any passengers travelling under your booking must wear seatbelts where required by law.

You are responsible for ensuring that any child, dependent passenger or person travelling under your booking complies with applicable seatbelt, restraint, child seat and safety requirements.

5.5 Children and Child Restraints

You are responsible for ensuring that any child travelling on a trip is lawfully and safely restrained in accordance with applicable road safety laws.

Where a child restraint, booster seat or other safety device is required, you are responsible for providing and fitting it unless Bounce expressly states otherwise.

A Driver may refuse or cancel a trip where the Driver reasonably believes that a child cannot be transported safely or lawfully.

5.6 Passenger Numbers and Vehicle Capacity

You must not request or continue a trip with more passengers than the vehicle can lawfully and safely carry.

A Driver may refuse or cancel a trip if the number of passengers exceeds the seating capacity, seatbelt availability, service type capacity or legal limits for the vehicle.

5.7 Luggage and Personal Items

You are responsible for ensuring that your luggage, bags, mobility aids, prams, equipment and personal items are suitable for the vehicle and can be safely loaded, carried and unloaded.

A Driver may refuse to carry items that are unsafe, unlawful, oversized, offensive, unsanitary, likely to damage the vehicle or not reasonably suitable for the trip.

5.8 Smoking, Vaping and Vehicle Conduct

You must not smoke, vape or allow smoking or vaping in a vehicle during a trip or while entering, exiting or waiting in the vehicle.

You must not consume alcohol, use unlawful drugs, damage the vehicle, leave rubbish, soil the vehicle, behave aggressively or create an unsafe or unpleasant environment for the Driver or other passengers.

5.9 Assistance Animals and Accessibility

Bounce supports access for Riders and passengers with disability and Riders accompanied by lawful assistance animals.

Assistance animals are not pets. Where you travel with an assistance animal, you are responsible for ensuring that the animal remains under effective control and does not create a safety risk.

You should provide accurate information about accessibility needs where reasonably necessary for the trip, including where you require space for a mobility aid, assistance animal or other lawful accessibility requirement.

5.10 Pets

Pets may only be taken on trips where permitted by the Bounce Rider Platform, the selected service type, the Driver, Bounce policy or applicable law.

You are responsible for your pet’s behaviour, safety, cleanliness and any mess, damage, injury or disruption caused by your pet.

5.11 No Off-Platform Trips

All Bounce trips must be requested, accepted, completed and paid for through the Bounce Platform.

You must not ask, pressure or encourage a Driver to cancel a Bounce trip, accept cash, arrange an off-platform trip, avoid Bounce fees, bypass the Bounce Platform or provide transport outside the Bounce Platform.

5.12 Reporting Issues

You must promptly report safety issues, accidents, incidents, complaints, lost property, suspected unlawful conduct, Driver issues, app issues, trip disputes, fare disputes or any other matter required by Bounce, Bounce policies or applicable law.

6. Trips, Bookings and Service Standards

6.1 Trip Requests

When you request a trip, Bounce Ride may display trip information such as pickup location, destination, estimated fare, estimated arrival time, service type, Driver information, vehicle information or other relevant information.

A trip request is not guaranteed until it is accepted by a Driver through the Bounce Platform.

6.2 Pickup Location

You are responsible for selecting a safe, lawful and accurate pickup location.

You must not request a pickup from a location that is unsafe, unlawful, inaccessible, likely to obstruct traffic, prohibited by road rules, or otherwise unsuitable for stopping or passenger pickup.

6.3 Driver and Vehicle Verification

Before entering a vehicle, you should check that the Driver, vehicle and registration plate match the details shown in Bounce Ride.

You should not enter a vehicle if the Driver, vehicle or registration plate does not match the details shown in Bounce Ride or if you have a safety concern.

6.4 OTP, PIN or Trip Verification

The Bounce Rider Platform may use a one-time password, PIN or other verification process before a trip can begin.

You must not share your trip verification code with anyone except the correct Driver for the purpose of starting the correct trip.

You should not provide your verification code by phone, message or outside the in-person trip start process unless Bounce expressly allows it.

6.5 Starting, Completing and Ending Trips

Trips must start and end through the Bounce Platform and in accordance with the in-app trip process.

You must not ask a Driver to falsely start, complete, cancel, alter or manipulate a trip, route, fare, toll, waiting time, cancellation fee or other trip record.

6.6 Routes and Destinations

The Driver is responsible for driving safely and lawfully. You may provide reasonable route or destination instructions, but you must not ask the Driver to drive unlawfully, unsafely, dangerously or in breach of road rules.

Route guidance, estimated arrival times and fare estimates may change due to traffic, weather, road closures, safety issues, navigation limitations, Driver judgment, Rider instructions or other legitimate reasons.

6.7 Changes to Destination

You may be able to change your destination through the Bounce Rider Platform where the feature is available.

Changing a destination may affect the fare, route, duration, Driver availability, service type, estimated arrival time and any applicable fees.

6.8 Driver Cancellations

A Driver may cancel a trip where permitted by the Bounce Driver App, these Terms, Bounce policies or applicable law, including where the trip cannot be completed safely or lawfully.

6.9 Rider Cancellations

You may cancel a trip where permitted by Bounce Ride, these Terms, Bounce policies or applicable law.

Cancellation fees may apply in accordance with the information displayed in the Bounce Platform, applicable rate cards, Bounce policies and applicable law.

7. Waiting Time, Cancellations and No-Shows

7.1 Waiting Time at Pickup Location

Once the Driver arrives at the nominated pickup location, you are responsible for being ready to enter the vehicle and commence the trip within the applicable waiting period.

7.2 Rider Not Ready or Not Present

If you do not attend the pickup location, are not ready to commence the trip, or cause the Driver to wait beyond any free waiting period notified in the Bounce Platform, waiting time charges may apply.

7.3 Waiting Time Charges

Waiting time charges may be calculated and charged in accordance with the rate cards, timeframes, service types and fee information displayed in the Bounce Platform from time to time.

7.4 Unsafe or Unlawful Waiting Locations

A Driver should not stop, stand or wait at a pickup location if doing so would be unsafe, unlawful, impractical or likely to obstruct traffic.

If a pickup location is unsafe, unlawful or inaccessible, you may need to move to a safe and lawful pickup location or follow the in-app process.

7.5 Cancellation Fees

Cancellation fees may apply where you cancel a trip after a Driver has accepted the request, where the Driver has travelled towards the pickup location, where you do not attend the pickup location, or in any other circumstances displayed in the Bounce Platform or Bounce policies.

7.6 Cancellation Misuse

You must not misuse cancellation functions, including by repeatedly requesting and cancelling trips without reasonable cause, asking Drivers to cancel to avoid fees, cancelling to arrange an off-platform trip, or using cancellation features in a fraudulent, abusive or misleading way.

8. Fares, Fees and Payments

8.1 Fare Information and Estimates

Bounce may make available fare information, fare estimates, upfront fares, fees, levies, tolls, surcharges, discounts, promotions, cancellation fees, waiting time charges, cleaning fees, lost item return fees and payment information through the Bounce Platform.

8.2 Fare Estimates and Final Fares

Fares may be calculated or displayed based on factors such as trip type, pickup location, destination, estimated or actual time and distance, demand, traffic, tolls, levies, airport fees, booking fees, promotions, discounts, cancellation fees, waiting time, service category, applicable taxes and any other fare or pricing rules made available by Bounce from time to time.

Fare estimates, trip estimates and Rider prices displayed in the Bounce Platform may be estimates only and may differ from the final amount payable.

8.3 Minimum Fares

A minimum fare may apply to all trips. The fare may be calculated so that the applicable minimum amount is payable, even if the estimated or actual time, distance or other fare components would otherwise result in a lower amount.

8.4 Fare Adjustments

Final fares, fees or payment amounts may be adjusted to reflect the actual trip, route, time, distance, tolls, levies, promotions, discounts, refunds, payment issues, safety issues, fraud prevention, complaints, disputes, errors or any other matter reasonably connected with the trip.

8.5 Payment Methods

You must maintain a valid payment method where required to request or complete trips through the Bounce Rider Platform.

By requesting a trip or using paid features, you authorise Bounce and its payment providers to charge your selected payment method for fares, fees, tolls, levies, cancellation fees, waiting time charges, cleaning fees, lost item return fees, adjustments and any other amounts payable in connection with your use of the Bounce Platform.

8.6 Failed Payments

If a payment fails, is declined, reversed, disputed, subject to chargeback or cannot be processed, Bounce may require you to provide another payment method, retry the payment, restrict access to the Bounce Rider Platform, withhold credits or promotions, recover outstanding amounts, or take other action reasonably necessary.

8.7 Tolls, Levies, Airport Fees and Surcharges

You may be charged tolls, levies, airport fees, booking fees, surcharges or other amounts connected with a trip where displayed in the Bounce Platform, required by law, charged by a third party, or otherwise applicable to the trip.

8.8 Surcharges

Bounce may apply surcharges to trips where reasonably required due to factors such as high demand, peak travel periods, public holidays, special events, airport or venue access requirements, severe weather, traffic conditions, regulatory requirements, third-party charges, operational costs or other circumstances notified through the Bounce Rider Platform.

Any applicable surcharge may be included in the fare estimate, upfront fare, final fare or other amount displayed in the Bounce Rider Platform before or during the trip request process.

Surcharges may vary by location, time, trip type, service category, demand, availability of Drivers, route, destination or other factors reasonably connected with the trip.

By confirming a trip request, you agree to pay any surcharge displayed or otherwise made available to you through the Bounce Rider Platform, subject to your rights under the Australian Consumer Law and any other applicable law.

8.9 Cleaning and Damage Fees

If you, a passenger travelling under your booking, or an animal travelling with you causes mess, soiling, contamination, damage or unreasonable cleaning requirements in a Driver’s vehicle, Bounce may charge you a cleaning fee, damage fee or other reasonable cost.

Bounce may determine the amount having regard to the nature and severity of the mess or damage, evidence provided, receipts, trip circumstances and any relevant Bounce policy.

8.10 Lost Item Return Fees

If you report that you have left an item in a Driver’s vehicle, Bounce may facilitate communication between you and the Driver through the Bounce Platform or another approved contact method to help arrange the return of the item.

Bounce may charge you a lost item return fee, cancellation fee, delivery fee or other applicable fee to compensate the Driver for the time, travel and costs involved in returning the item.

8.11 Refunds, Credits and Chargebacks

Bounce may refund, credit, adjust, reduce, reverse, withhold or recover any fare, fee, credit, promotion or other amount where Bounce reasonably considers it necessary or appropriate, including where:

  1. you were incorrectly charged;
  2. a trip fare, fee, toll, levy, surcharge, discount or promotion was incorrectly calculated or applied;
  3. a trip was not completed, was cancelled, or was affected by a technical issue, payment issue, platform issue or processing error
  4. you raise a complaint, dispute, safety issue, service issue or payment issue;
  5. Bounce reasonably believes that a trip, fare, fee, refund, credit, promotion or account activity was false, improper, unsafe, unlawful, fraudulent, misleading, abusive, disputed, made in error, subject to chargeback, or inconsistent with these Terms or Bounce policies;
  6. a refund, credit, adjustment, reversal or chargeback is required by applicable law, a payment provider, card scheme, bank, regulator or court; or
  7. Bounce otherwise reasonably considers that an adjustment is required in connection with a trip, payment or use of the Bounce Platform.

A chargeback occurs when a Rider, cardholder, bank, card scheme or payment provider disputes, reverses, withholds or recovers a payment made through the Bounce Platform.

8.12 Receipts and Trip History

The Bounce Rider Platform may make available trip history, trip details, receipts, tax invoices, payment records and other records relating to trips requested, completed, cancelled or paid for through the Bounce Rider Platform.

These records may be updated, corrected or adjusted where reasonably required to reflect final fares, payment processing, refunds, disputes, complaints, errors, fraud prevention, safety issues, legal requirements or other matters connected with a trip or payment.

8.13 Payment Disputes

If you dispute a fare, fee, charge, refund, credit, receipt, trip record or other account record, you must notify Bounce Support as soon as reasonably practicable and provide any information reasonably requested to assess the dispute.

Bounce may review relevant trip, account, payment, GPS, location, support, Rider, Driver, communication, safety and platform information to assess, investigate and resolve the dispute.

9. Promotional Codes and Referral Discounts

9.1 Promotional Codes, Discounts and Credits

Bounce may, from time to time, offer or make available promotional codes, referral codes, referral links, referral credits, discounts, vouchers, rewards or other offers through the Bounce Platform or by other approved means.

9.2 Eligibility and Conditions

These offers may be subject to additional terms, eligibility requirements, expiry dates, location limits, service-type restrictions, usage limits, trip or activity requirements, payment method requirements or other conditions notified by Bounce at the time of the offer.

9.3 Use of Offers

Promotional codes, referral discounts and other offers:

  1. must only be used for their intended purpose;
  2. may only be used by eligible users and accounts;
  3. may be limited to specific Riders, trips, locations, dates, services, payment methods or other conditions;
  4. cannot be transferred, sold, exchanged, redeemed for cash or combined with other offers unless Bounce allows it;
  5. are not guaranteed and will only be applied where Bounce determines, acting reasonably, that all applicable requirements have been met; and
  6. may be refused, reversed, cancelled, adjusted or withheld where permitted by these Terms, the relevant offer terms or applicable law.

9.4 Misuse, Fraud or Error

Bounce may refuse, reverse, cancel, adjust or withhold a promotional code, referral discount or other offer if Bounce reasonably believes that the offer was misused, fraudulent, misleading, artificial, made in error, obtained through multiple accounts, or otherwise inconsistent with these Terms, Bounce policies or the conditions of the relevant offer.

9.5 Changes to Offers

Bounce may change, suspend or withdraw any promotional code, referral program, referral code, referral discount or other offer at any time, subject to applicable law.

10. Safety, Incidents and Emergency Features

10.1 Safety Obligations

You must use the Bounce Rider Platform and receive transport services in a safe, lawful, respectful and responsible manner.

You must take reasonable care for your own health and safety, the health and safety of Drivers, passengers and other road users, and the safety of any vehicle used for a trip arranged through the Bounce Platform.

10.2 Accidents, Safety Issues and Incidents

You must promptly report to Bounce any accident, collision, safety issue, injury, emergency, threat, assault, harassment, complaint, Driver misconduct, suspected unlawful conduct, lost property issue or other incident connected with your use of the Bounce Rider Platform or a trip arranged through Bounce.

10.3 Emergency Services

You must take reasonable steps to protect your safety and the safety of Drivers, passengers and other road users during or after an incident, including contacting emergency services where appropriate.

In an emergency in Australia, call 000.

Bounce safety features and support tools are not a substitute for contacting emergency services in an emergency.

10.4 Safety Toolkit

Bounce Ride may make available a Safety Toolkit on trip screens during a trip to support Rider safety, emergency access and trip verification while using the Bounce Rider Platform.

The Safety Toolkit may include features such as:

  1. Contact 000, which allows a Rider to contact emergency services where there is an immediate threat to life, safety or property;
  2. Follow My Ride, which allows a Rider to share selected trip details with nominated trusted contacts, including trip status, approximate location and trip progress; and
  3. Proof of Trip Activity, which may display limited trip and account information to assist with confirming whether a Rider is currently on a trip or was recently on a trip.

10.5 SOS, Emergency and Check-In Features

Emergency assistance features must only be used where you reasonably believe there is an emergency or immediate safety concern.

Bounce may send check-in notifications or safety prompts where Bounce detects unusual trip activity, extended stops, route changes, safety events, SOS use, emergency assistance activity, unexpected delays, abnormal location signals or other circumstances that may require confirmation of your safety, the Driver’s safety or the status of a trip.

You must respond to any check-in notification, safety prompt, verification request or account notice within the time and manner reasonably required by Bounce.

10.6 Incident Information and Evidence

You must provide Bounce with accurate and complete information about any incident, including trip details, time, location, persons involved, vehicle details, photographs, documents, police details, medical or emergency attendance details and any other information reasonably requested by Bounce.

10.7 Cooperation with Regulators, Police and Insurers

You must cooperate with Bounce, insurers, regulators, police, transport authorities and other relevant authorities in relation to any safety issue, incident, complaint, investigation, insurance claim, legal process, regulatory request or compliance review.

10.8 Bounce Reviews and Safety Action

Bounce may review trip activity, GPS data, location data, account activity, communications, support records, Rider feedback, Driver feedback, complaints, safety reports, payment information and other relevant information to assess, investigate or respond to safety issues, incidents, complaints, disputes, insurance claims, regulatory requests or suspected breaches of these Terms, Bounce policies or applicable law.

Bounce may restrict, suspend or deactivate your access to the Bounce Platform where Bounce reasonably believes there is a safety, compliance, legal, regulatory, insurance, fraud, investigation or platform integrity reason to do so.

11. Assistance Animals and Pets

11.1 Assistance Animals

Bounce supports lawful access for passengers accompanied by assistance animals.

Assistance animals are not pets and may be legally permitted to accompany Riders in transport services.

Where you travel with an assistance animal, you are responsible for ensuring that the animal remains under effective control and does not create a safety risk.

11.2 Pets

Where you are travelling with a pet that is not an assistance animal, you must comply with any applicable Bounce pet trip option, Driver acceptance requirement, vehicle cleanliness requirement, safety requirement and applicable law.

You are responsible for ensuring that any pet travelling with you is controlled, safe, clean, appropriately restrained where required, and does not create a safety risk or cause unreasonable damage or mess.

12. Lost Items

12.1 Rider Responsibility for Belongings

You are responsible for your own personal belongings and for checking that you have all belongings before leaving a vehicle.

12.2 Reporting Lost Items

If you believe you have left an item in a Driver’s vehicle, you should report the lost item through the Bounce Rider Platform or contact Bounce Support as soon as reasonably practicable.

12.3 Return of Lost Items

Bounce may facilitate communication between you and the Driver through the Bounce Platform or another approved contact method to help arrange the return of the item.

Bounce does not guarantee that a lost item will be found, stored, returned or recovered.

12.4 Lost Item Return Fees

Bounce may charge you a lost item return fee, cancellation fee, delivery fee or other applicable fee to compensate the Driver for the time, travel and costs involved in returning the item.

12.5 Unclaimed, Unsafe or Unlawful Items

If an item is unsafe, unlawful, valuable, perishable or inappropriate to store, the Driver or Bounce may contact police or another lawful authority.

13. Ratings, Feedback and User Content

13.1 Ratings and Feedback

The Bounce Rider Platform may allow Riders, Drivers and Bounce to provide ratings, reviews, feedback, reports, comments, complaints or other information about trips, users, vehicles, conduct, safety, service quality and platform experience.

13.2 Use of Ratings and Feedback

Bounce may use ratings, feedback, complaints, safety reports, cancellation patterns, trip activity, support interactions and other platform information for safety, quality assurance, customer support, complaint handling, dispute resolution, fraud prevention, compliance, training, account review, platform improvement and enforcement of these Terms.

13.3 Honest Ratings and Feedback

You must provide ratings, feedback, reports and complaints honestly, fairly and in good faith.

You must not submit false, misleading, abusive, discriminatory, threatening, defamatory, fraudulent, malicious, irrelevant or inappropriate ratings, feedback, reports, complaints or comments.

13.4 No Pressure or Retaliation

You must not pressure Drivers to provide a particular rating or retaliate against Drivers for ratings, complaints or feedback.

13.5 User Content

You may be able to upload, submit, provide or make available content through the Bounce Rider Platform, including profile information, images, messages, support requests, incident reports, feedback, ratings, comments, complaints, location information, trip information and other materials.

You are responsible for any content you submit, upload, provide or make available through the Bounce Rider Platform.

13.6 Content Standards

You must ensure that your content is accurate, current, complete and lawful, and that you have all rights, permissions and authority required to provide it to Bounce.

You must not upload, submit, provide or make available any content that:

  1. is false, misleading, inaccurate, expired, altered, incomplete or fraudulent;
  2. is unlawful, threatening, abusive, harassing, defamatory, obscene, offensive, discriminatory, hateful or otherwise inappropriate;
  3. infringes another person’s privacy, confidentiality, intellectual property rights or other legal rights;
  4. contains personal information about another person without lawful authority or consent;
  5. contains malware, viruses, harmful code, automated scripts or anything that may interfere with the Bounce Rider Platform;
  6. impersonates another person or misrepresents your identity, authority, account status or relationship with Bounce; or
  7. is submitted for an improper purpose, including fraud, harassment, manipulation of ratings, avoidance of enforcement action or misuse of the Bounce Rider Platform.

13.7 Bounce’s Use of User Content

You retain ownership of any intellectual property rights you hold in content you submit, but you grant Bounce a worldwide, royalty-free, non-exclusive, transferable and sublicensable licence to use, copy, store, reproduce, modify, adapt, publish, communicate, display, distribute and otherwise process that content for the purposes of operating, administering, improving, securing, enforcing and promoting the Bounce Rider Platform, responding to support matters, investigating complaints or safety issues, complying with legal obligations and enforcing these Terms.

13.8 Moderation, Removal and Restrictions

Bounce may review, moderate, remove, restrict, hide, disable or refuse to publish any rating, feedback, comment, report, complaint or user content where Bounce reasonably believes it breaches these Terms, Bounce policies, applicable law, platform standards, safety requirements or the rights of another person.

14. Device, Network, Location and Technical Requirements

14.1 Device and Network Requirements

You are responsible for ensuring that you have the equipment, software, internet connection and settings needed to access and use the Bounce Rider Platform.

14.2 Location Services

To access and use certain features of Bounce Ride, you may need to enable location services and allow Bounce Ride to access your device location when required, including when requesting trips, selecting pickup or drop-off locations, using safety features or otherwise using location-based features of the Bounce Rider Platform.

14.3 Use of Location Data

Location services allow Bounce to provide, operate and improve key platform functions, including:

  1. matching Riders with available Drivers;
  2. identifying pickup and drop-off locations;
  3. calculating routes, distance, duration, fares, fees, tolls and surcharges;
  4. supporting trip tracking, safety, incident reporting and emergency features;
  5. detecting app misuse, fraud, off-platform trips, location manipulation or unusual trip activity;
  6. verifying trip start, trip progress and trip completion; and
  7. supporting customer service, complaints, disputes, refunds and regulatory compliance.

14.4 Location Information

Location information may include GPS location, approximate location, real-time location, background location where enabled or required, pickup and drop-off locations, route information, trip start and end locations, trip distance, trip duration, timestamps, device location signals, network-based location information and other location-related information generated through your use of the Bounce Rider Platform.

14.5 Sharing Location Information

Bounce may share location information with Drivers, trusted contacts, emergency contacts, support teams, emergency services, third-party providers, insurers, regulators, law enforcement agencies or other persons where reasonably required to operate the Bounce Rider Platform, complete trips, respond to safety matters, investigate incidents, resolve disputes, process payments, comply with legal obligations or protect the rights, safety and interests of Bounce, Riders, Drivers or the public.

14.6 Retention of Location Information

Bounce may retain location information and location-related trip data for as long as reasonably required for the purposes for which it was collected, including operating the Bounce Rider Platform, maintaining trip records, processing payments, issuing receipts, managing refunds, investigating incidents, responding to safety matters, complying with legal, tax, insurance, audit and regulatory obligations, detecting fraud, enforcing these Terms and resolving disputes.

14.7 Device Permissions and App Access

To use certain features of the Bounce Rider Platform, you may need to allow Bounce Ride to access certain functions, settings or information on your device.

This may include access to your camera, photo library, files, location services, notifications, mobile data, network connection, device information, microphone, storage, background activity and other device permissions required for the proper operation of the Bounce Rider Platform.

14.8 Managing Permissions

You may manage device permissions through your device settings. However, disabling or refusing certain permissions may affect your ability to access or use some features of the Bounce Rider Platform, including trip requests, location selection, navigation, safety features, notifications, support uploads and account verification.

14.9 Maps, Navigation and Route Guidance

Maps, navigation, route guidance, location data and arrival estimates may be affected by limitations, outages, delays, errors, signal loss, device settings, app permissions, network coverage, traffic conditions, mapping data, third-party service availability or other factors outside Bounce’s reasonable control.

14.10 Mobile Charges

Your mobile carrier’s data, messaging, roaming and other charges may apply. You are responsible for those charges.

15. Privacy and Personal Information

15.1 Privacy Policy

Bounce collects, uses, holds, discloses, stores and protects personal information in accordance with the Bounce Privacy Policy and applicable privacy laws.

15.2 Information Collected and Used

By using the Bounce Rider Platform, you acknowledge that Bounce may collect and handle information about you, your account, your device, your trips, your payments, your location, your support requests, your safety reports and your use of the Bounce Rider Platform in accordance with the Bounce Privacy Policy.

15.3 Relationship with Privacy Policy

These Terms should be read together with the Bounce Privacy Policy. If there is an inconsistency between these Terms and the Bounce Privacy Policy in relation to the handling of personal information, the Bounce Privacy Policy applies to the extent of the inconsistency, unless otherwise required by law.

16. Third-Party Services

16.1 Use of Third-Party Providers

Bounce may use third-party services, systems, software, platforms, integrations, application programming interfaces, payment processors, identity verification providers, mapping and navigation providers, app stores, device operating systems, cloud storage providers, communication providers, analytics providers, customer support providers and other service providers from time to time.

16.2 Authorisation to Use Third-Party Services

You authorise Bounce to access, use, transmit, receive, share, process and store information through third-party services where reasonably required to operate, provide, support, secure, verify, administer, improve or enforce the Bounce Rider Platform.

This may include use for account creation, identity verification, payment processing, trip requests, trip tracking, navigation, fare calculation, safety features, customer support, complaints, investigations, fraud prevention, compliance, regulatory reporting, tax, accounting and platform integrity purposes.

16.3 Third-Party Terms

Your use of certain Bounce Platform features may require you to comply with third-party terms, policies or requirements, including payment provider terms and app marketplace terms.

16.4 Third-Party Availability

Third-party services may be affected by outages, delays, errors, updates, maintenance, restrictions or discontinuation outside Bounce’s reasonable control.

Bounce is not responsible for the acts, omissions, availability, accuracy, delays, outages, processing times, fees, systems, terms, privacy practices or retention practices of third-party providers, except to the extent required by law.

16.5 Information Sharing with Third Parties

Bounce may collect, use, disclose and share information with third-party providers in accordance with Bounce’s Privacy Policy, these Terms and applicable law.

17. Software Licence, Copyright and Intellectual Property

17.1 Software Licence

Subject to your compliance with these Terms, Bounce grants you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to download, install, access and use Bounce Ride solely for the purpose of accessing and using the Bounce Rider Platform as a Rider.

17.2 App Licensed, Not Sold

Bounce Ride is licensed to you, not sold. You do not acquire any ownership rights in Bounce Ride, the Bounce Rider Platform, Bounce’s systems, software, source code, databases, content, branding, trade marks, business names, logos, designs, interfaces, workflows, features or other intellectual property.

17.3 Restrictions on App Use

You must not copy, modify, adapt, reverse engineer, decompile, disassemble, interfere with, bypass, misuse, sell, rent, lease, sublicense, assign or commercially exploit Bounce Ride, except to the extent expressly permitted by these Terms or applicable law.

17.4 Intellectual Property Ownership

All copyright, trade marks, business names, logos, branding, designs, layouts, interfaces, graphics, icons, images, text, content, software, code, databases, workflows, features, functionality, documentation and other intellectual property rights in or connected with Bounce Ride, the Bounce Rider Platform and Bounce’s systems are owned by Bounce or its licensors.

17.5 No Unauthorised Use

You must not use Bounce’s name, logos, branding, app content, screenshots, software, data, materials or intellectual property except as expressly permitted by Bounce.

Nothing in these Terms transfers ownership of any Bounce intellectual property to you.

18. App Availability, Downtime and Updates

18.1 Platform Availability

Bounce will take reasonable steps to maintain the availability, security and functionality of the Bounce Rider Platform.

Bounce does not guarantee that the Bounce Rider Platform, Bounce Ride, trip requests, payment features, navigation, location services, notifications, support features or any other platform feature will be available, accurate, uninterrupted, secure or error-free at all times.

18.2 Maintenance, Updates and Technical Issues

The Bounce Rider Platform may be unavailable, delayed, restricted, suspended, interrupted or affected by maintenance, updates, technical issues, system outages, internet or mobile network failures, device issues, app store issues, third-party service failures, payment processing delays, cyber incidents, security risks, high demand, regulatory requirements, emergency circumstances or events outside Bounce’s reasonable control.

18.3 Platform Changes

Bounce may update, modify, suspend, replace, restrict, remove or discontinue all or part of the Bounce Rider Platform from time to time, including for security, compliance, maintenance, technical, operational, safety, legal, business or product reasons.

18.4 Trip Requests and App Functionality

You acknowledge that app downtime, technical issues, connection issues, location inaccuracies, notification delays, payment processing delays, mapping errors, third-party service failures or other platform issues may affect your ability to log in, request trips, receive notifications, use safety features, access records, make payments or use other Bounce Ride features.

18.5 Correction of Technical, Pricing or Payment Errors

Where a technical issue, system error, pricing error, payment error or platform malfunction affects a trip, fare, fee, payment, promotion, account status or trip status, Bounce may review the issue and make any reasonable correction, adjustment, reversal or recovery.

18.6 No Exploitation of Bugs or Errors

You must not knowingly exploit, misuse or take advantage of any bug, glitch, system error, payment error, pricing error, promotion error or other technical issue.

If Bounce reasonably believes you have done so, Bounce may adjust affected amounts, recover credits or refunds, suspend or deactivate your account, or take other action reasonably necessary.

19. Suspension, Restriction and Deactivation

19.1 Bounce’s Right to Suspend, Restrict or Deactivate Access

Bounce may suspend, restrict, limit, place on hold, deactivate or otherwise prevent access to all or part of the Bounce Rider Platform if Bounce reasonably believes that doing so is necessary or appropriate under these Terms, Bounce policies, applicable law or for safety, security, compliance, payment, fraud prevention or platform integrity reasons.

19.2 Grounds for Suspension, Restriction or Deactivation

Bounce may suspend, restrict, limit, place on hold, deactivate or otherwise prevent access if Bounce reasonably believes that:

  1. you have breached these Terms, Bounce policies or applicable law;
  2. your account, payment method, identity information or contact details are invalid, incomplete, misleading, fraudulent, expired, unverifiable or require review;
  3. your conduct may present a safety, security, legal, regulatory, financial, fraud, operational, reputational or platform integrity risk to Bounce, Drivers, Riders, the public or any third party;
  4. you have engaged in unsafe, unlawful, fraudulent, misleading, abusive, discriminatory, threatening, violent, harassing, inappropriate or unprofessional conduct;
  5. you have requested, offered, accepted or arranged cash payments, off-platform payments, off-platform trips or other unauthorised benefits with a Driver;
  6. you have misused the Bounce Rider Platform, referral codes, promotional offers, cancellations, refunds, credits, chargebacks, cleaning fee processes, lost item processes or payment systems;
  7. you have failed to cooperate with a complaint, safety report, incident report, investigation, identity check, payment review or regulatory request;
  8. Bounce is required or reasonably requested to do so by law, a regulator, law enforcement agency, payment provider, insurer, court, tribunal or other competent authority;
  9. your account, device, location data, trip activity, payment activity or use of the Bounce Rider Platform appears false, suspicious, unauthorised, compromised, inconsistent or otherwise requires review; or
  10. Bounce otherwise reasonably considers suspension, restriction, deactivation or other action necessary to protect safety, comply with law, prevent misuse, manage risk, investigate concerns or maintain the integrity of the Bounce Platform.

19.3 Immediate Action Without Prior Notice

Where appropriate, Bounce may notify you of the reason for the suspension, restriction or deactivation and any steps available to you to seek review, provide further information or remedy the issue.

However, Bounce may take immediate action without prior notice where Bounce reasonably considers this necessary for safety, security, legal, fraud, payment, insurance, regulatory, compliance, operational or platform integrity reasons.

19.4 Effect of Suspension, Restriction or Deactivation

A suspension, restriction or hold may be temporary or indefinite, depending on the circumstances.

During any suspension, restriction, hold or deactivation, you may be unable to request trips, access certain features, use promotions, receive credits, update payment methods, receive support through some channels, or use some or all parts of the Bounce Rider Platform.

19.5 Continuing Obligations

Suspension, restriction or deactivation does not affect any rights, obligations or liabilities that arose before the suspension, restriction or deactivation, including any obligation to pay amounts owed, cooperate with investigations, resolve disputes, return property, comply with legal or regulatory obligations, or provide information reasonably requested by Bounce.

20. Account Cancellation, Deletion and Closure

20.1 Rider-Requested Account Deletion

You may request to delete your Bounce Rider account by following the process made available in Bounce Ride or by contacting Bounce Support.

If you request deletion of your account, Bounce may still retain certain information where required or permitted by law, including for legal, regulatory, tax, accounting, safety, insurance, fraud prevention, dispute resolution, complaints, investigations, payment processing, record-keeping or platform integrity purposes.

20.2 Account Deletion

If you request deletion of your Bounce Rider account, Bounce may treat this as a request to permanently close and delete your account from the Bounce Rider Platform.

Account deletion is irreversible. Once your account has been deleted or closed, you may not be able to restore your previous account, trip history, receipts, settings, payment information, promotional benefits or access to Bounce Ride features.

20.3 Bounce-Initiated Account Closure

Bounce may close, cancel or delete your account if:

  1. you request account cancellation or deletion;
  2. your account has been inactive for an extended period;
  3. your access to the Bounce Rider Platform has been suspended, restricted or deactivated and Bounce reasonably determines that your account should be closed;
  4. Bounce is required or reasonably requested to do so by law, a regulator, authority, payment provider, insurer, court order or other lawful process;
  5. Bounce reasonably believes your account has been misused, compromised, used fraudulently or used to bypass any suspension, restriction, deactivation, verification process or payment requirement; or
  6. continued account access is inconsistent with these Terms, Bounce policies, applicable law, safety, security, compliance or the proper operation of the Bounce Platform.

20.4 Outstanding Trips, Payments and Disputes

Before or after account closure, cancellation or deletion, Bounce may process, adjust, offset, recover or charge any outstanding amounts relating to trips, fares, refunds, chargebacks, tolls, fees, levies, adjustments, promotions, disputes, complaints or payment processing issues.

20.5 Record Retention

Bounce may retain records relating to your account, trips, payments, communications, safety reports, complaints, investigations, compliance history and platform activity for as long as reasonably required for legal, regulatory, insurance, tax, audit, safety, fraud prevention, dispute resolution, operational or legitimate business purposes.

20.6 Clauses That Continue After Closure

Any provisions of these Terms that by their nature are intended to continue after account cancellation, closure, deletion, suspension, restriction, deactivation or termination will continue to apply, including provisions relating to payments, fees, refunds, records, investigations, compliance, liability, indemnities, privacy, intellectual property, dispute resolution and governing law.

21. Complaints and Investigations

21.1 Complaints

Bounce may receive, review and manage complaints, reports, feedback, safety concerns, payment disputes, service issues or other concerns relating to Riders, Drivers, trips, accounts, vehicles, payments, conduct, platform use or compliance with these Terms.

Complaints may be made by Riders, Drivers, Bounce staff, third-party service providers, regulators, law enforcement, members of the public or other relevant persons.

21.2 Complaints and Responses

You must provide accurate, complete and honest information when making or responding to a complaint.

You must not make any complaint, report or statement that is false, misleading, malicious, abusive, discriminatory, threatening, defamatory, fraudulent or made for an improper purpose.

21.3 Investigations

Bounce may investigate any complaint, report, safety concern, payment issue, suspected breach of these Terms, suspected fraud, suspected unlawful conduct, suspected platform misuse, account issue, trip issue, Rider concern, Driver concern or other matter affecting safety, compliance, trust, payments or platform integrity.

21.4 Information Reviewed

As part of an investigation, Bounce may review trip records, account information, ratings, feedback, messages, support communications, payment information, location information, device information, app activity, incident reports and other information available to Bounce.

Bounce may also request further information, documents, photographs, explanations, evidence, police reports, insurance information, regulatory information or other materials reasonably required to assess the matter.

21.5 Cooperation

You must cooperate reasonably and promptly with any complaint review, safety review, compliance check, payment review or investigation conducted by Bounce.

You must provide accurate, current and complete information and must not delay, obstruct, interfere with, manipulate or refuse to participate in an investigation where Bounce reasonably requires your cooperation.

You must not contact, intimidate, harass, threaten, retaliate against or attempt to influence any Driver, Rider, witness, complainant, Bounce staff member, regulator or other person involved in a complaint or investigation.

21.6 Investigation Outcomes

Following a complaint review or investigation, Bounce may take any action it reasonably considers appropriate, including:

  1. taking no further action;
  2. providing education, guidance, reminders or warnings;
  3. requiring updated information, payment details, verification or safety checks;
  4. adjusting, refunding, withholding, recovering or correcting payments, fees, fares, charges, credits or records;
  5. restricting access to certain features, trip requests or platform functions;
  6. suspending, deactivating or closing a Rider account; or
  7. reporting a matter to a regulator, law enforcement, insurer, payment processor or other relevant third party where required or permitted by law.

21.7 No Guarantee of Outcome

Bounce will assess complaints and investigations based on the information reasonably available to it at the time.

Bounce does not guarantee that every complaint, report, dispute or concern will be investigated, resolved, verified or determined in favour of any particular person, except where required by law.

22. Electronic Communications

22.1 Consent to Electronic Communications

By creating an account, accessing the Bounce Platform or using Bounce services, you agree that Bounce may send you electronic communications as part of the normal operation of the platform.

22.2 Types of Communications

These communications may include emails, SMS messages, in-app notifications and messages, push notifications and other electronic messages.

22.3 Transactional, Operational and Safety Messages

Electronic communications may relate to your account, trips, bookings, payments, receipts, safety alerts, support, platform updates, service announcements, verification, legal notices, document updates, payment notices or other matters connected with your use of Bounce.

You cannot opt out of transactional, operational, safety, legal or account-related messages, including trip updates, receipts, payment notifications, support responses, safety alerts, verification messages and important platform notices.

22.4 Contact Details

You must ensure that the email address, mobile phone number and other contact details linked to your Bounce Rider account are accurate, current and accessible at all times.

You are responsible for regularly checking your email, SMS messages, in-app messages, push notifications and any other communication channels linked to your Bounce Rider account.

22.5 Incorrect or Inaccessible Contact Details

If your contact details are incorrect, outdated, inaccessible or no longer monitored, you may miss important communications.

Bounce is not responsible for any loss, delay, missed trip request, account restriction, failed verification, missed payment notice, support notice or other consequence caused by your failure to keep your contact details accurate, current and accessible.

22.6 Marketing and Promotional Messages

Where permitted by law, Bounce may also send you marketing, promotional or referral-related communications.

You can opt out of marketing communications at any time through your Profile page, notification settings, unsubscribe links or any other method made available by Bounce.

Opting out of marketing communications does not affect your receipt of important service-related, safety, legal or account communications.

22.7 Notices Through the Bounce Platform

Bounce may give notices through Bounce Ride, email, SMS, the Bounce website, in-app message, push notification or another reasonable method.

23. Liability and Indemnity

23.1 Liability Exclusions

To the maximum extent permitted by law, Bounce is not liable for any loss, damage, cost, expense, injury, delay, missed booking, missed connection, inconvenience, payment issue, data loss, unauthorised access, app outage, third-party provider issue, Driver conduct, Rider conduct, route issue, vehicle issue, lost item, cleaning issue or other matter arising from or connected with your use of the Bounce Rider Platform, except to the extent caused by Bounce’s breach of these Terms, negligence, wilful misconduct or as otherwise required by law.

23.2 App Downtime and Technical Exclusions

To the maximum extent permitted by law, Bounce is not liable for any loss, damage, cost, expense, claim, delay, interruption, loss of opportunity, loss of data, loss of goodwill, reputational harm, business interruption or consequential loss arising from or connected with:

  1. the unavailability, interruption, suspension, delay, error or failure of the Bounce Rider Platform;
  2. your inability to access Bounce Ride, request trips, complete bookings, make payments or use platform features;
  3. device, network, internet, GPS, mapping, notification, operating system, app store or third-party service issues;
  4. maintenance, updates, security measures, technical changes or platform modifications;
  5. inaccurate, delayed, incomplete or unavailable trip, location, fare, payment or account information;
  6. unauthorised access, cyber incidents, fraud, account misuse or security issues, except to the extent caused by Bounce’s fraud, wilful misconduct or breach of law; or
  7. any event outside Bounce’s reasonable control.

23.3 Driver and Third-Party Conduct

To the maximum extent permitted by law, Bounce is not liable for the conduct, statements, omissions, property, actions, behaviour, requests, cancellations, complaints or disputes of Drivers, passengers or other third parties.

You are responsible for exercising your own judgment when requesting, entering, continuing, cancelling or completing a trip, subject to these Terms, Bounce policies and applicable law.

23.4 Rider Indemnity

To the maximum extent permitted by law, you agree to indemnify Bounce, its related bodies corporate, directors, officers, employees, contractors, agents and service providers against any loss, liability, claim, demand, damage, cost or expense, including reasonable legal costs, arising from or in connection with:

  1. your access to, use of, or misuse of the Bounce Rider Platform;
  2. any trip, attempted trip, cancelled trip or service arranged through the Bounce Rider Platform;
  3. any breach of these Terms, Bounce policies or applicable law by you;
  4. any negligent, reckless, fraudulent, misleading, unlawful or wilful act or omission by you;
  5. any personal injury, property damage, loss, complaint, dispute or claim arising from your conduct, passenger conduct, trip conduct or interaction with a Driver or third party;
  6. any information, declaration, statement or content you provide to Bounce, a Driver, regulator, payment provider or third-party service provider that is false, misleading, incomplete or inaccurate;
  7. your breach of privacy, confidentiality, recording, data protection, intellectual property or communication laws;
  8. any off-platform arrangement, cash trip, solicitation, conversion or trip conducted outside the Bounce Rider Platform; or
  9. any claim made by a Driver, passenger, regulator, authority, insurer, payment provider or other third party arising from your conduct or use of the Bounce Platform.

23.5 Exclusions from Indemnity

Your indemnity does not apply to the extent that the relevant loss, liability, claim, damage, cost or expense was caused by Bounce’s fraud, wilful misconduct, gross negligence or breach of applicable law.

23.6 Consumer Guarantees and Non-Excludable Rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy, warranty or protection that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

Where Bounce is permitted by law to limit its liability, Bounce’s liability is limited, at its option, to supplying the relevant services again or paying the cost of having the services supplied again.

23.7 Duty to Mitigate

You must take reasonable steps to minimise any loss, damage, cost, delay or expense arising from or in connection with your use of the Bounce Rider Platform, including by promptly notifying Bounce of any issue, dispute, error, safety concern, payment issue or suspected unauthorised access.

24. Amendments to These Terms

24.1 Changes to These Terms

Bounce may amend, update or replace these Terms from time to time.

24.2 Notice of Material Changes

Where Bounce makes material changes to these Terms, Bounce will take reasonable steps to notify you, which may include notice through Bounce Ride, email, the Bounce website or another reasonable method.

24.3 When Updated Terms Apply

The updated Terms will apply from the date stated in the notice or, if no date is stated, from the date they are made available to you.

24.4 Continued Use After Changes

By continuing to access or use the Bounce Rider Platform after the updated Terms take effect, you agree to be bound by the updated Terms.

24.5 If You Do Not Agree to Updated Terms

If you do not agree to the updated Terms, you must stop using the Bounce Rider Platform and may cancel your account in accordance with these Terms.

24.6 Rights Preserved Under Applicable Law

Nothing in this section limits any rights you may have under the Australian Consumer Law or any other applicable law.

25. Governing Law

25.1 Governing Law

These Terms are governed by the laws of Victoria, Australia, unless mandatory laws of another Australian state or territory apply.

25.2 Jurisdiction

You and Bounce submit to the non-exclusive jurisdiction of the courts of Victoria, Australia, and any courts entitled to hear appeals from those courts.

25.3 Compliance with Applicable Laws

You must comply with all applicable laws, regulations, rules, codes, standards and regulatory requirements that apply to your access to, and use of, the Bounce Rider Platform and your use of trips arranged through Bounce.

25.4 Other States and Territories

If you access or use the Bounce Rider Platform outside Victoria, you are responsible for complying with any additional laws, regulations, safety and operating requirements that apply in the state or territory where you use the Bounce Rider Platform.

25.5 No Limitation of Non-Excludable Rights

Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee or protection that cannot lawfully be excluded, restricted or modified under applicable law.
